To ensure Charlie’s Electrical Services Pty Limited (CES) meets its commitment to customers in relation to the protection of their personal information and its privacy obligations under law by:

  • if it is necessary for one or more of CES’ business activities;
  • by lawful and fair means; and
  • from the relevant individual, if reasonable and practicable to do so.

Customer information must only be used and disclosed:

  • for the primary purpose for which it was collected (e.g. to notify Endeavour Energy or Ausgrid etc of electrical work); or 
  • if the customer has consented to such use or disclosure; or
  • in limited circumstances relating to dealings with government bodies and law enforcement agencies.

Reasonable steps must be taken to protect customer information from misuse, loss and unauthorised access, modification and disclosure.

As privacy matters to everyone, employees and contractors:

  • must comply with this Policy at all times by always following the relevant internal procedures
  • must not engage in behaviour, or ignore or allow behaviour by others, that breaches this Policy.
  • must promptly raise issues or suspected breaches of this Policy to the appropriate Manager.

Managers must lead by example and demonstrate a strong commitment to privacy compliance, by:

  • identifying privacy compliance risks and implementing appropriate controls to manage those risks.
  • ensuring employees and contractors are aware of CES’ privacy policy and statement.
  • taking appropriate action to deal with privacy issues, such as remedial and preventative actions.


CES will continue to

Review and maintain its processes and practices to meet changes and developments in the law and in CES’ business operations.

If employees and contractors do not comply with this Company Policy, they may face disciplinary action. This disciplinary action may involve a verbal or written warning or, in serious cases, termination of your employment or engagement with CES. If employees or contractors break the law they may also be personally liable.

This privacy statement applies to the Company, Charlie’s Electrical Services Pty Limited (CES) and all employees, contractors and customers of the Company.

We provide a range of electrical services in residential, commercial and industrial sectors.

The Company is committed to protecting the privacy and security of personal information held about its customers and employees. Our purpose is to assure anyone who does business with the Company complies with the Privacy Act 1988. The following statement is our commitment to ensure that the collection, use, disclosure and security of personal information comply with the provisions of the Privacy Act in terms of legal conformity and practical fortitude. In particular, the Company’s Privacy Policy aims to comply with the National Privacy Principles (NPPs).

The Company reserves the right to change the Privacy Policy from time to time and will post the updated version of the policy on its website. Where a major change is made, customers will be informed by e-mail notification or through a notice on our website. Customers and site visitors bear the responsibility to ensure that they have read the changes or updates as the case may be.

Personal information held by us may include your name, mailing address, building address, telephone or mobile phone number, email address. We may also hold worksite photographs, building plans and specifications.


If you choose not to provide certain information (e.g. building plans and specifications), we may not be able to provide you with the services you require, or the level of service on which we pride ourselves. 


Occasionally, you may need to provide information about other individuals to us (e.g. your builder). If so, we rely on you to inform those individuals that you are providing their contact information to us and to advise them that we can be contacted for further information if required.

The Company’s web portal may contain many links to sites that belong to third parties unrelated to the Company.


The Company cannot be held responsible for any use of personal information arising from you disclosing such personal information on third party sites. The Company cannot protect any information you may disclose on these sites and recommends that you review the privacy policy statements of those sites you visit.


The Company does not collect personal information about you if you only browse the website. 

The Company’s website does not employ cookies.


how we collect personal information

The Company only collects personal information in a manner which is lawful, fair and non-intrusive. 


The company collects personal information in a number of different ways depending on the type of dealings that a person may have with the Company (e.g. consumers, employees or business relations). 


These methods of collection include:

  • directly      from you to undertake our daily administrative operations, for example,      when you provide information by phone, in person or by other means of      electronic correspondence such as email or when you submit your personal details through our website (e.g. through a website enquiry or survey)
  • from third parties such as credit reporting agencies, your builder etc; 
  • photographs from the worksite
  • from publicly available sources of information (e.g. telephone directories); 
  • from the organisations identified under 'When we disclose your personal information';      
  • from our own records of when you previously used our services;


how we use your personal information

The Company treats its obligations with respect to the use and disclosure of personal information very seriously. The Company only use your personal information for the purposes for which you give it to us and for related, internal management purposes.  Any information CES collects from you through correspondence with us, whether via website enquiry, e-mail, telephonically or by written letter, will only be used to address the matters within that correspondence. If this requires referring such correspondence within CES or to a third party to ensure customer service, your personal information will only be disclosed to the point necessary to address your query or concerns, and will otherwise be kept confidential.


In summary, the Company collects personal information for the following purposes:

  • to provide the services you      require; 
  • to administer and manage those services, including charging, billing and      collecting debts; 
  • to inform you of ways the services provided to you could be improved; 
  • to conduct appropriate checks for credit-worthiness and for fraud; 
  • to research and develop our services; 
  • in relation to worksite images, these may be used to assist us to do our work or for marketing/website purposes


when we disclose your personal information

The Company will not sell, rent, trade or otherwise supply to third parties any personal information obtained unless consent has been given. However, the Company may disclose personal information in some circumstances including where contractors and service providers help the Company operate our business or provide a service such as: 

  • Endeavour Energy or Ausgrid for submitting a notification of electrical work (NOWE);
  • Level 2 service providers;
  • EC Credit Control or Creditorwatch for debt-recovery functions; 

  

If the Company is required to provide personal information to contractors and/or service providers, reasonable steps are taken to ensure that these organisations are bound by confidentiality and privacy obligations in relation to the protection of your personal information. Before any such information is released the Company would require these organisations or individuals to agree to comply with our Privacy Policy and agreements shall be in place to ensure the Company’s policy is adhered to.


In addition to the above, we may disclose your personal information to:

  • your authorised representatives or your legal advisers (e.g. when requested by      you to do so); 
  • credit-reporting and debt recovery agencies - we may provide customer      information to credit reporting and debt collection agencies if the account remains overdue for more than 60 days. The information will allow the credit reporting agency to create or maintain a credit information file about the customer and the debt collection agency to take recovery action. The information disclosed may include: details of customer identity, amounts that are overdue by more than 60 days and for which have been sent reminder notices to the last known address, dishonoured cheques drawn by the customer for $100 or more which have been dishonoured more than once.  
  • credit providers (for credit related purposes such as credit-worthiness, credit      rating, credit provision and financing); 
  • our professional advisers, including our accountants, auditors and lawyers;      and
  • government and regulatory authorities and other organisations, as required or      authorised by law

security

The Company has security procedures and technology to protect against the loss, misuse and/or alteration of the information under its control. Databases on the internal Company server are security protected to appropriately limit access to those individuals who collected the information. The Company employees are required to maintain the confidentiality of any personal information held by the Company.


help us to ensure we hold accurate information

If an organisation or individual wishes to change personal information that is inaccurate, incomplete or out‐of‐date, they may contact Charlie’s Electrical Services by mail or e‐mail. 

Any personal information that is no longer used by the Company (based on annual review) will be securely destroyed – in doing so, careful steps are taken to destroy or de-identify personal information.


you can access your personal information

Organisations and individuals can contact the Company to request access to their information. In normal circumstances we will give you full access to your information.  However, there may be some legal or administrative reasons to deny access. If access is denied, we will provide you with the reason why.
